General Information

GUSTATORY is a trading name of F&W Group, a company in The United Kingdom whose principle address is Studio 3.3, Banks Mills, 71 Bridge Street, Derby, DE1 3LB, with VAT Registration no. GB378731163. Described herein are our terms and conditions, please read these carefully.

These terms and conditions apply to all purchases made through the marketplace, in addition to all other associated products that are available to order on this website. GUSTATORY is a marketplace company and thereby acts as an agent for each of our independent coffee roasters, tea makers and brands, all of which are herein referred to as the ‘supplier’.

For any purchases, you will be entering into a contract with the supplier(s) you have purchased from. Accordingly, in addition to the terms and conditions of GUSTATORY, the terms and conditions of the supplier(s) will apply to your purchase. You agree to be bound by these terms and conditions, as well as the terms and conditions of the supplier(s), including their cancellation and amendment policies. A link to a copy of the terms and conditions of each respective supplier(s) can be accessed through each suppliers storefront on the GUSTATORY marketplace.

We reserve the right to change these terms and conditions of use from time to time. If this happens, we will notify you by posting the new terms and conditions for buying goods online on the website.

Terms & Conditions Contract

These are the terms in which we will sell coffee, tea and other drinks, as well as all other associated products to you through the GUSTATORY marketplace. When making your purchase we will arrange for you to enter into a contract with the supplier(s) (e.g. coffee roasters, tea makers and brands) named on your receipt(s). We can connect you with a single supplier of the products, into which you will enter a contract, or, if your purchase is with multiple suppliers, you will have separate contracts with each of them. As an agent we accept no responsibility for the acts or omissions of the supplier(s) or for the products provided by them. The supplier(s) terms and conditions will apply to your purchase and we advise you to read these carefully as they do contain important information about your purchase. Please ask us for copies of these if you do not have them.

Our Terms of Business are governed by English Law and the jurisdiction of the English Courts. You may, however, choose the law and jurisdiction of Scotland or Northern Ireland if you wish to do so. All coffee, tea and other drinks, in addition to all other associated products which we provide and are sold through the GUSTATORY website are not an offer by us to sell, but are available by invitation for you to make an offer to the suppliers of their suppliers. We are free to accept that offer on behalf of those suppliers, or to reject it.

Purchasing Process & Payment Authorisation

When a purchase is made, all details will be displayed back to you for your review. Once you have confirmed these details we will proceed to confirm the booking with the supplier(s). Please check that all names, addresses, product details and volumes are correct on receipt of all documents and advise us of any errors immediately. The purchase information that you provide to us will be passed on only to the relevant suppliers of your order. Certain information may also be passed on to credit checking companies. In making this purchase, you consent to this information being passed on to the relevant persons, in compliance with our privacy policy.

You will be required to make full payment for your goods when purchasing. Payments must be made by debit card or credit card via one of our payment gateway providers (Shopify / Paypal / Google Pay / Apple Pay). Please note orders will be dispatched only once we have authorisation from your payment card issuer. We will not be liable if there is a delay, and we will not accept your order if payment is not authorised. Certain steps are followed for a contract to be formed, as described below, after you have placed your order. All documents (e.g. invoices/receipts) will be emailed to the address provided at the time of purchase.

Customer Complaints

Because the contract(s) for your coffee, tea and other drinks purchases, in addition to all other associated products is between you and the supplier(s), any queries or concerns will be processed by us but should be addressed to them for their attention. If you have a problem, this must be reported to us immediately. If you fail to follow this procedure there will be less opportunity to investigate and rectify your complaint. The amount of compensation you may be entitled to may be reduced or you may not receive any at all depending upon the circumstances. You will see the name and address plus contact details in any confirmation documents we send you.

GUSTATORY takes no responsibility for any loss or damage suffered as a result of using our website, or goods supplied using it, except as required by law, even if we could have foreseen the loss, or the possibility of it was brought to our attention. We are liable for loss, damage, death or personal injury resulting from our negligence or any fraudulent misrepresentations, whilst our suppliers are each responsible for the quality of their own respective produce that you purchase. All payments made by Direct Debit are protected by the Direct Debit Guarantee.

These Terms & Conditions for buying goods online are governed by the law of England and you and we agree to use the English courts if there is any dispute between us. If any part of these Terms & Conditions for buying goods online is found to be invalid by law, the rest of them remain valid and enforceable.
